+
+TAKEDOWN NOTICE, pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512), based on the facts and legal grounds set forth below, against:
+
+(NOTIFIED PARTY) GITHUB, INC., a private legal entity with registered offices at [private], based on the facts and legal grounds set forth below.
+
+SUMMARY  
+This notice follows up on the extrajudicial notice previously sent by the Notifying Party on June 16, 2026, concerning the identification of copyrightprotected content belonging to the Notifying Party, reproduced without authorization in a public repository hosted on the GitHub platform. The Notifying Party has verified that some of the links then indicated have already been removed; however, infringing files and directories remain publicly accessible. This matter is particularly relevant because:
+
+a. the Notifying Party holds copyrights over the systems, platforms, source codes and databases related to its technological solutions, including the AfyaConecta application, pursuant to Brazilian Law No. 9,610/1998 and the Digital Millennium Copyright Act;
+
+b. remaining files and directories are still publicly accessible in the repository HudsonSilva83/AfyaConecta, containing unauthorized reproduction of source code, configuration files and internal system architecture belonging to the Notifying Party;
+
+c. the user responsible for the repository does not have formal authorization from the Notifying Party to reproduce, publish or distribute such content;
+
+d. the public exposure of these materials compromises the information security, competitive advantage and system integrity of the Notifying Party.
+
+In light of the foregoing, this notice is formal and urgent in nature, requiring the immediate removal of the remaining infringing content herein identified.
+
+FACTS The Notifying Party, AFYA PARTICIPAÇÕES S.A., is a leading institution in medical education in [private], with 38 undergraduate campuses, 32 of which offer Medicine programs, operating in 14 [private] states.  
+In connection with its operations, the Notifying Party has developed and maintains proprietary technological systems, including the AfyaConecta application, a digital platform for the exclusive use of its employees and students, whose source code and internal architecture constitute a protected intellectual work. In the regular course of monitoring its digital assets, and in follow-up to the extrajudicial notice sent on June 16, 2026, the Notifying Party found that, although part of the reported content has already been removed, the repository HudsonSilva83/AfyaConecta remains public and still contains files and directories reproducing elements of the internal architecture of its proprietary system, as detailed below.

However, the repository remains public, and the following files and directories, which are part of the internal architecture of the AfyaConecta system, have not yet been removed:

+The continued presence of remaining computer program source code files and directories without authorization constitutes a direct violation of Article 7, XII, and Article 29, I, of Brazilian Law No. 9,610/1998, as well as of 17 U.S.C. § 106(1) of the United States Copyright Act.
+
+LEGAL GROUNDS  
+The content herein identified constitutes intellectual works protected under Brazilian Law No. 9,610/1998 and the United States Copyright Act (17 U.S.C.). Computer programs and organized databases are expressly protected under Article 7, XII and XIII, of Law No. 9,610/1998, and their reproduction without authorization is prohibited under Article 29, items I and IX, of the same statute.
+
+The Brazilian Superior Court of Justice (Superior Tribunal de Justiça) has held that software protection does not depend on registration and follows the copyright law model, as established in [private], reported by [private], and in AgInt no [private], decided on November 20, 2023. The Notifying Party has a good faith belief that the use of the content described in the identified repository is not authorized by the copyright owner, its agents, or the law.
+
+The Notifying Party considered the possibility of fair use and concludes that the identified reproductions exceed any reasonable limit, particularly because they involve functional source code, internal operational workflows, and images of restricted platforms, made fully available in the public repository.
+
+The Notifying Party states, under penalty of perjury, that the information contained in this notice is accurate and that it is authorized to act on behalf of the owner of the rights described herein. The Notifying Party has read and understands GitHub's Guide to Submitting a DMCA Takedown Notice.
+
+REQUESTS In view of the facts and legal grounds set forth above, the Notifying Party requests that GITHUB, INC., within a maximum term of 10 (ten) calendar days, adopt the following measures:
+
+a. immediately remove all remaining infringing files and directories herein identified in the “AfyaConecta” repository;  
+b. permanently delete any derivative copies (forks) and references (pull requests) related to content owned by the Notifying Party;  
+c. prevent the republication of the removed content on the same accounts or on related accounts;  
+d. notify the Notifying Party of the details of the measures adopted, with evidence of full compliance.
+
+Failure to comply within the indicated term may give rise to the adoption of applicable judicial measures under the DMCA and applicable Brazilian law.
+
+This concludes the present notice.
